***LONG BEACH COMMUNITY ACTION ALERT***

If you care about maintaining public rights on the Lake Michigan beach – NOW IS THE TIME FOR ACTION: OPPOSE SB 581 and SUPPORT SB 553!!!

OPPOSE SB 581! – This is a confusing and deceptive bill that would try to un-do the Indiana Supreme Court’s ruling in the Gunderson case by re-defining Ordinary High Water Mark as an invisible elevation on the beach that will generally allow little, if any, beach for public use. While denying the public its rights, SB 581 would create a new zone on the beach in which adjacent property owners have special recreational rights that are denied to others. Finally, SB 581 attempts to create a zone in which DNR’s minimal regulation on the beach would over-ride coast municipalities’ shore protection ordinances and zoning authority and even supersede local ordinances on municipally owned park and dune property, such as in Michigan City and Gary.

SUPPORT SB 553! – This bill simply codifies the Indiana Supreme Court’s ruling in Gunderson that the Lake Michigan beach is owned by the State and held in trust for the public’s use up to the natural Ordinary High Water Mark, which is generally the visible vegetation line. SB 553 also enumerates the type of recreational uses that are protected on the public trust beach – basically the traditional uses that we all have made of the beach for generations. This bill is important because it will end disputes about the boundary of public and private land and clarify recreational activities allowed on the public beach.
